Note on Data Transfer to the USA
Our websites include or use tools from companies based in the USA. When these tools are active, your personal data can be transferred to the US servers of the respective companies. We would like to point out that the USA is not a safe third country in the sense of EU data protection law. US companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g., intelligence services) process, evaluate, and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.
Revocation of Your Consent to Data Processing
Many data processing operations are only possible with your express consent. You can revoke consent that you have already given at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.
Right to Object to Data Collection in Special Cases and to Direct Advertising (Art. 21 DSGVO)
IF THE DATA PROCESSING IS BASED ON ART. 6 PARA. 1 LIT. E OR F DSGVO, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH A PROCESSING IS BASED CAN BE FOUND IN THIS DATA PROTECTION DECLARATION. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN PROVE COMPELLING LEGITIMATE REASONS FOR THE PROCESSING THAT OUTWEIGH YOUR INTERESTS, RIGHTS, AND FREEDOMS OR THE PROCESSING SERVES THE ASSERTION, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION ACCORDING TO ART. 21 PARA. 1 DSGVO).
IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH ADVERTISING AT ANY TIME; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT ADVERTISING PURPOSES (OBJECTION ACCORDING TO ART. 21 PARA. 2 DSGVO).
Right to Lodge a Complaint with the Competent Supervisory Authority
In the event of violations of the DSGVO, the data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work, or the place of the alleged violation. The right to lodge a complaint exists without prejudice to other administrative or judicial remedies.
Right to Data Portability
You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another responsible party, this will only be done to the extent that it is technically feasible.
SSL or TLS Encryption
This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from
“http://” to “https://” and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Encrypted Payment Transactions on this Website
If there is an obligation to provide us with your payment data (e.g., account number for direct debit authorization) after the conclusion of a fee-based contract, this data is required for payment processing.
Payment transactions via the common means of payment (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL or TLS connection. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.
In the case of encrypted communication, your payment data that you transmit to us cannot be read by third parties.
Information, Deletion, and Correction
Within the framework of the applicable legal provisions, you have the right to free information about your stored personal data, its origin and recipient, and the purpose of the data processing and, if applicable, a right to correction or deletion of this data at any time. For this and other questions on the subject of personal data, you can contact us at any time at the address given in the imprint.
Right to Restriction of Processing
You have the right to request the restriction of the processing of your personal data. For this, you can contact us at any time at the address given in the imprint. The right to restriction of processing exists in the following cases:
If you dispute the accuracy of your personal data stored with us, we usually need time to check this. For the duration of the check, you have the right to request the restriction of the processing of your personal data.
If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
If you have lodged an objection pursuant to Art. 21 para. 1 DSGVO, a balance must be struck between your and our interests. As long as it is not yet clear whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data may only be processed – apart from being stored – with your consent or for the assertion, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.
4. Data Collection on this Website
Cookies
Our internet pages use so-called “cookies”. Cookies are small text files and do not cause any damage to your end device. They are either temporarily stored for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted after your visit. Permanent cookies remain stored on your end device until you delete them yourself or an automatic deletion by your web browser occurs.
In some cases, cookies from third-party companies may also be stored on your end device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g., cookies for processing payment services).
Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies are used to evaluate user behavior or display advertising.
Cookies that are required to carry out the electronic communication process (necessary cookies) or to provide certain functions you have requested (functional cookies, e.g., for the shopping cart function) or to optimize the website (e.g., cookies to measure the web audience) are stored on the basis of Art. 6 para. 1 lit. f DSGVO, unless another legal basis is specified. The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies has been requested, the storage of the relevant cookies is based exclusively on this consent (Art. 6 para. 1 lit. a DSGVO); the consent can be revoked at any time.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or generally, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.
Insofar as cookies from third-party companies or for analysis purposes are used, we will inform you about this separately within the framework of this data protection declaration and, if necessary, request your consent.
To manage the cookies and similar technologies (tracking pixels, web beacons, etc.) used and the consents related to them, we use the consent tool “Real Cookie Banner”. Details on the functionality of “Real Cookie Banner” can be found at <a href=”https://devowl.io/de/rcb/datenverarbeitung/” rel=”noreferrer” target=”_blank”>https://devowl.io/de/rcb/datenverarbeitung/</a>.
Legal bases for the processing of personal data in this context are Art. 6 para. 1 lit. c DS-GVO and Art. 6 para. 1 lit. f DS-GVO. Our legitimate interest is the management of the cookies and similar technologies used and the consents related to them.
The provision of personal data is neither contractually required nor necessary for the conclusion of a contract. You are not obliged to provide the personal data. If you do not provide the personal data, we cannot manage your consents.
Server Log Files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- Browser type and browser version
- Operating system used
- Referrer URL
- Hostname of the accessing computer
- Time of the server request
- IP address
This data is not merged with other data sources.
The collection of this data is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – for this purpose, the server log files must be recorded.
Contact Form
If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.
The processing of this data is based on Art. 6 para. 1 lit. b DSGVO, provided that your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6 para. 1 lit. f DSGVO) or on your consent (Art. 6 para. 1 lit. a DSGVO) if this has been requested.
The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your inquiry has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.
Inquiry by E-Mail, Phone, or Fax
If you contact us by e-mail, phone, or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of processing your request.
The data you send to us via contact inquiries will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions – in particular legal retention periods – remain unaffected.
5. Plugins and Tools
Google Web Fonts
This site uses so-called web fonts provided by Google for the uniform display of fonts. When you call up a page, your browser loads the required web fonts into its browser cache to display texts and fonts correctly.
For this purpose, the browser you are using must connect to Google’s servers. This gives Google knowledge that this website was accessed via your IP address. The use of Google WebFonts is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the uniform presentation of the typeface on its website. If a corresponding consent has been requested (e.g., consent to the storage of cookies), the processing is based exclusively on Art. 6 para. 1 lit. a DSGVO; the consent can be revoked at any time.
If your browser does not support web fonts, a standard font from your computer will be used.
Further information on Google Web Fonts can be found at https://developers.google.com/fonts/faq and in Google’s privacy policy: https://policies.google.com/privacy?hl=de.
6. eCommerce and Payment Providers
Processing of Data (Customer and Contract Data)
We collect, process, and use personal data only to the extent necessary for the establishment, content, or modification of the legal relationship (inventory data). This is done on the basis of Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfillment of a contract or pre-contractual measures. We collect, process, and use personal data about the use of this website (usage data) only to the extent necessary to enable the user to use the service or to bill for it.
The collected customer data will be deleted after completion of the order or termination of the business relationship. Legal retention periods remain unaffected.
Data Transfer upon Conclusion of a Contract for Services and Digital Content
We only transfer personal data to third parties if this is necessary in the context of contract processing, for example, to the credit institution commissioned with payment processing.
A further transmission of the data does not take place or only if you have expressly consented to the transmission. Your data will not be passed on to third parties without your express consent, for example, for advertising purposes.
The basis for data processing is Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.
7. Audio and Video Conferences
Data Processing
For communication with our customers, we use, among other things, online conference tools. The tools we use in detail are listed below. If you communicate with us via video or audio conference via the Internet, your personal data will be recorded and processed by us and the provider of the respective conference tool.
The conference tools collect all data that you provide/use to use the tools (e-mail address and/or your phone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants, and other “context information” related to the communication process (metadata).
Furthermore, the provider of the tool processes all technical data required for the handling of online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection.
If content is exchanged, uploaded, or otherwise provided within the tool, it is also stored on the servers of the tool providers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared during the use of the service.
Please note that we have no full influence on the data processing operations of the tools used. Our options are largely determined by the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the data protection declarations of the respective tools used, which we have listed under this text.
Purpose and Legal Bases
The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 para. 1 sentence 1 lit. b DSGVO). Furthermore, the use of the tools serves the general simplification and acceleration of communication with us or our company (legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO). If consent has been requested, the use of the relevant tools is based on this consent; the consent can be revoked at any time with effect for the future.
Storage Duration
The data collected directly by us via the video and conference tools will be deleted from our systems as soon as you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your end device until you delete them. Mandatory legal retention periods remain unaffected.
We have no influence on the storage duration of your data, which is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly.
